Session Description:
Practitioners who live in those nine – mostly western – states that adhere
to the community property regime are familiar with the principle of what’s
mine is ours and understand the attendant tax consequences, but are then b
affled by the intricacies of tax treatment in separate property jurisdictio
ns. This course will examine the history of community property, its applica
tion, and its benefits and detriments. And then the class will go one step
further with a survey of international community property laws and their im
pact on US tax filing obligations.

#1: Understand that community property arises by operation of law and that community property laws can help protect the rights of women.
#2: Distinguish between community and separate property, and use the taxpayer’s domicile to properly determine whether acquired property is sub ject to an applicable community property regime.
#3: Offer certain ta xpayers relief from community property laws with the application of special allocation rules under IRC §879.
