Description: Ethics - Understanding Recent Update of the Due Diligence Penalty

Due diligence requirements serve an important function in curbing problem-preparers and decreasing the risk of improper refunds to ineligible taxpayers. However, IRC § 6695(g) has transformed into something which is nearly unnavigable to many preparers and those advising them. Come learn about the background to the IRC § 6695(g) penalty, address recent revisions to the applicable due diligence regulation, and highlight other potential problems with the current system that may impact you.

Kevan McLaughlin is Certified Tax Law Specialist whose practice focuses on civil and criminal tax controversy and litigation matters. In addition to representing taxpayers before the IRS, FTB, CDTFA, EDD, CUIAB, U.S. Tax Court and Department of Justice in civil and criminal tax matters, McLaughlin has a unique practice in defending accounting professionals before the California Board of Accountancy (CBA), the IRS, and the IRS’s Office of Professional Responsibility (OPR) who are accused of violating various statutes and regulations, including Circular 230 provisions. McLaughlin is also an adjunct professor atSDSU's Charles W. Lamden School of Accountancy where he teaches "Ethics for Accountants."
