Mr. Carpenter will review the di
fferent steps in a typical criminal tax case, he will explain the differenc
e between criminal tax case versus civil tax fraud. Mr. Carpenter will rev
iew the different Title 26 and Title 18 criminal tax statute. In addition,
he’ll explain Title 31 offenses – including Currency Transact
ion Reports, Structuring Transactions, and IRS Form 8300. Finally, Mr. Car
penter will review the steps in a typical criminal tax case.

Richard has been a
tax controversy attorney in San Diego for the past 32 years. He is certifi
ed as a specialist in taxation law by the State Bar of California. Richard
has been named a “Super Lawyer” every year since 2008. He has
also been selected annually by his peers as one of the Best Lawyers in Ame
rica. Richard has represented thousands of clients in all phases of tax co
ntroversy; including being the lead attorney in many civil tax litigation c
ases in the U.S. Tax Court, as well as many criminal tax cases in U.S. Dist
rict Court. In one of his most notable tax cases, Perez v. Commissioner, t
he issue was whether or not a woman who donated her eggs after undergoing f
ertility treatment in exchange for payment, could exclude this payment from
her taxable income because of the pain and suffering she went through in t
he procedure. In addition, for the past 24 years Richard has also taught th
e criminal tax class, and the tax litigation class at USD Law, as an Adjunc
t Professor.
